Terms of Service

This is a plain-language legal document written for clarity. It does not constitute legal advice. Defined terms are used consistently across our legal pages.

These Terms of Service ("Terms") govern your access to and use of the GeoQ API, websites, SDKs and related services (together, the "Service"), operated by GeoQ ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

GeoQ provides an HTTP API that returns abuse signals, geolocation, network (ASN) data and a risk score for IP addresses. The Service is provided on a self-service, plug-and-play basis under the plan you select.

2. Signals are probabilistic, not facts

You acknowledge and agree that every value returned by the Service — including all signals, the risk object and geo data — is probabilistic and inferential. It represents our best estimate and is not a statement of fact about any IP address, network or person. Geolocation is approximate and locates a network, not a device. Certain signals (including residential-proxy and bot detection) are provided as beta features and may be materially less reliable.

You must not treat any output as a definitive determination, and you must exercise independent judgement before acting on it.

3. Your responsibilities and acceptable use

Your use of the Service is subject to our Acceptable Use Policy ("AUP"), which is incorporated into these Terms. In particular, and without limitation, you must not use the Service as the sole basis of an automated decision producing legal or similarly significant effects concerning an individual (see the AUP and Article 22 GDPR), and you must preserve required attribution.

4. Accounts and API keys

You are responsible for keeping your API keys confidential and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend access to protect the Service or other customers.

5. Plans, fees and quotas

Paid plans are billed monthly in advance via our payment processor. Plans carry flat daily lookup quotas rather than per-query metering; exceeding a quota results in rate-limiting, not additional charges. Fees are non-refundable except where required by law. We may change pricing on reasonable notice; changes do not affect your current billing period.

6. Beta features

Features labelled "beta" are provided for evaluation, may change or be withdrawn, may be less accurate, and are excluded from any service-level commitments. Your use of beta features is at your own risk.

7. Intellectual property

We retain all rights in the Service. You retain rights in your own data. You are granted a limited, non-exclusive, non-transferable right to use the Service and its output in your own applications, subject to these Terms, the AUP and applicable third-party data licences (see Attributions). You may not resell or redistribute GeoQ data in bulk as a standalone dataset.

8. Third-party data

The Service incorporates third-party data, including IP geolocation data licensed from DB-IP under CC BY 4.0 and publicly published IP ranges and lists. Your use must comply with the licences described on our Attributions page.

9. Disclaimer — provided "AS IS"

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SIGNAL IS CORRECT OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.

Liability cap. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100). Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You will indemnify us against claims arising from your use of the Service in breach of these Terms or the AUP, including any use of output to make decisions about individuals contrary to the AUP or applicable law.

12. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for breach of these Terms or the AUP, or as required by law. Sections that by their nature should survive (including 2, 7–11) survive termination.

13. Changes

We may update these Terms; material changes will be notified by reasonable means. Continued use after changes take effect constitutes acceptance.

14. Governing terms

These Terms, the Privacy Policy, the AUP and, where applicable, the DPA form the entire agreement between you and us regarding the Service.
